Answer

If badgers are found on land purchased for development and are not causing damage but are 'just in the way', they cannot be subject of a DEFRA (Department for Environment Food and Rural Affairs) 'damage licence'.

There is no option in law to have them killed, removed or disturbed except under licence. Developers should seek advice through the appropriate statutory nature conservation agency: Natural England, Countryside Council for Wales or Scottish Natural Heritage.

If local residents wish to object to planning applications because of the presence of badgers they should do so through their nearest Badger Group or Wildlife Trust.

The RSPCA's factsheet Living with....badgers can be printed from this website or is available from Head Office to provide lots of information on feeding or deterring badgers.

A Natural England "Badgers and Development" booklet is also available free of charge from PO Box 1995, Wetherby, West Yorkshire, LS23 7XX or via their website.
